RETURN /CANCELLATIONS POLICIES
HAY IS RETURNABLE WITHIN 7 DAYS FOR IN-STORE CREDIT ONLY IF CONDITIONS STATED BELOW ARE FOLLOWED
. BUYER IS RESPONSIBLE FOR ALL LOADING; SHIPMENT TO AND RETURN SHIPPING; UNLOADING/RE-STACKING CHARGES. THESE CHARGES WILL BE DEDUCTED FROM YOUR PAYMENT AND THE BALANCE WILL BE APPLIED TO YOUR IN-STORE CREDIT. YOU HAVE 12 MONTHS FROM THE DATE YOUR CREDIT IS ISSUED TO USE YOUR CREDIT.
· Montana Custom Hay is a broker for the sale of hay which has been consigned to us.
· Although we do inspect all hay prior to acceptance for consignment the Producer is the ultimate responsible party for hay and the contents of the hay loaded and shipped by the Producer.
· Seller warrants that, at the time of delivery, to the Seller’s knowledge, the Goods will be free from material defects in materials and workmanship.
· Buyer shall have the right and obligation to inspect the Goods on arrival within 24 hours of receipt. A signed clean Bill or Lading (no notations of damages) automatically relieves Montana Custom Hay and the Producer of all liability.
· Top and bottom bales will be included in each order therefore, no allowances will be made for the same. Sun-bleached or weather damaged bales from aging in the stack are not allowed to be claimed as rejects UNLESS customer has paid for a tarp and paid the appropriate tarping fees in advance.
· In the event that you purchase year old hay (or older) no refunds or in-store credit will be allowed. All hay purchased after January 1 of any year (i.e. 2008 hay purchased after January 1, 2009) will not be eligible for a refund or in-store credit.
· Buyer must give specific written and photographic notice to Seller of any problems or defects associated with the Goods WITHIN 24 HOURS of the time of delivery. All problems MUST be noted within this period.
· Seller will forward to Producer the written and photographic notice and attempt to initiate a settlement between Buyer and Producer. Montana Custom Hay does not guarantee any suitable arrangements; refunds or returns from the Producer will be implemented.
· No cash refunds will be made by Montana Custom Hay. Any refunds allowed will be made in the form of in-store credit. ALL SALES ARE FINAL.
· Failure to provide such specific written notice within said 24 hour period shall result in Buyer’s deemed an irrevocable waiver of any right to make any claim against Seller or Producer with respect to problems associated with the Goods.
· No in-store credit or refund of any type will be issued to anyone purporting to be a private end user who after further investigation by MCH is discovered to be a retailer/broker of hay and the hay was rejected by the retailer/broker's customer for any reason. Retailers or brokers are obligated to identify themselves to MCH at the time of purchase. Should a claim arise from the Retailer/Broker for rejection by their customer, Retailer/Broker MUST disclose to MCH the name, address and phone number of their customer for verification. Retailer/Broker is responsible to their customers for any adjustments made. Montana Custom Hay does not warranty, guarantee and is NOT responsible to make any adjustments or in-store credits to a Retailer/Broker or their customer.
· If customer sends in their own trucks to pick-up or deliver hay Montana Custom Hay and their producers are relieved of any and all responsibility to the customer. We will not accept any claims, chargebacks, stop payments or arbitration on purchases made when customer uses their own resources for pick-up/delivery of hay purchased from MCH.
CANCELLATIONS
DUE TO THE NATURE OF THE HAY MARKET AND THE MANNER IN WHICH PAYMENTS ARE APPLIED AND PAYMENTS ARE MADE TO PRODUCERS, THERE ARE NO CANCELLATIONS ON HAY PURCHASES FOR ANY REASON
· ALL SALES ARE FINAL.
· CHANGES IN YOUR ORDER (i.e. substituting one type of hay for another or changing size of bale) WILL BE TREATED AS A RE-ORDER AND ALL MONIES PAID WILL BE USED AS AN IN-STORE CREDIT APPLIED TO ANY DIFFERENCES IN COST AND WILL BE EITHER CHARGED OR CREDITED AS APPROPRIATE.
MONTANA CUSTOM CARRIERS
DELIVERY SCHEDULE POLICIES
Montana Custom Carriers is the carrier of choice for Montana Custom Hay. While we endeavor to get your order out as soon as possible according to your schedule we sometimes experience delays due to weather, mechanical breakdown of loading equipment and other events beyond our control. You may live in an area where availability of trucks to go to this area is difficult to contract with, or you may not want your order for several weeks to months. Montana Custom Hay does at times use the services of other Common Carriers to deliver our products.
All customer orders are shipped in the order they are received and according to the availability of trucks. We do not allow cancellation of orders due to delays in delivery or because you want your order yesterday or tomorrow. We always urge customers to pre-plan their need for products and to order accordingly allowing a reasonable time frame for delivery. Normally deliveries are made 2-3 weeks after all paperwork has been completed and returned to our offices unless other arrangements (delivery at a later time) have been made at the time of sale.
Trucks are loaded Monday through Thursday 8AM-4PM and on Fridays 8AM-12PM Mountain Time. No weekend loading or deliveries will be made. You will need to have suitable arrangements in place to accept delivery of your purchase when it arrives. You have 2 hours to unload your hay. After the 2 hours time limit you will be charged $125 per hour for all additional unloading time. Drivers do not and are not required to assist you in unloading your truck. You may offer to pay your driver to assist you, however, it is at the driver's discretion.
We have many customers to deliver to and each customer is viewed as a VIP, poor planning on your part does not constitute a need for us to place you prior to any earlier customer for delivery.
You may cancel Montana Custom Carriers for delivery and arrange for delivery using a carrier of your own choosing. Should you cancel Montana Custom Carriers prior to your scheduled delivery you will incurr a cancellation fee of $300.00. Cancellations made less than 7 days prior to your scheduled delivery date will incur a service fee of $500.00 for truck ordered not used. This fee will be due and payable PRIOR to your pick-up.
All disputes arising between customer and Montana Custom Hay or Montana Custom Carriers shall be handled through the following method: Arbitration
1. Arbitration. If a controversy, claim or dispute arises or relates to any agreement, transaction or relationship between the undersigned parties, such matter shall be resolved solely and exclusively pursuant to confidential binding arbitration pursuant to the commercial arbitration rules of JAMS in existence at the time of the commencement of the arbitration. Any dispute as to whether a matter is covered by arbitration shall be resolved pursuant to this Agreement. The administrative fee charged by JAMS shall be advanced and paid for by the party bringing the arbitration action. The fees and expenses of the arbitrator shall be shared equally by the parties. Each party shall bear its own attorney fees and expert witness fees in connection with the arbitration. The arbitrator shall not award attorney's fees or costs to the prevailing party. Arbitration proceedings shall be held in Lewistown, Montana. This Agreement shall be governed by and construed in accordance with the laws of the State of Montana without regard to conflict of law principles.
